WRC rejects Eileen Kelly McCarthy’s discrimination complaint against Castlemartyr council

The Workplace Relations Commission found Eileen Kelly McCarthy was not discriminated against by Castlemartyr Community Council Company Limited by Guarantee on family status or disability grounds. The decision, dated 28 March 2023, said she lacked standing to bring the complaint in the form presented.

McCarthy said evening meeting times conflicted with her family commitments and disability, and that a request to move meetings earlier was refused. The council said it was a voluntary community group and denied discrimination. The adjudication officer accepted the council was a service under the Equal Status Act, but found McCarthy’s request for a change in meeting times was linked to education commitments and had been framed as a collective change rather than an individual discrimination claim.
