The Workplace Relations Commission directed Tara Support Services to pay cleaner Fernanda Guilherme Aureliano €1,600 compensation after finding that it had not provided her statutory annual leave. The decision was dated 3 April 2023.
Aureliano worked 20 hours a week and said she did not receive pay when she took holidays. Her employer said her wages included a 10% allowance for holidays and public holidays, and that she could opt out of the arrangement. The WRC found that an employer cannot substitute an allowance paid at another time for granting annual leave when it is taken.
The WRC found the complaint well founded. It said Aureliano worked 400 hours in the period it could examine and set compensation at €1,600 as just and equitable in the circumstances.
