The Workplace Relations Commission awarded Nadine Harty €20,000 after finding that she was sexually harassed and discriminated against on gender grounds at work. The decision, dated 24 March 2023, found her employer, Causeway Hospitality Ltd Greenway Manor Hotel, had failed to take appropriate measures to stop the harassment or reverse its effects.
Harty worked as a prep chef and said a male co-worker subjected her to unwanted touching and sexual comments. She said her complaints were not properly addressed and that she resigned as a result. The employer denied liability, saying it had policies and training and had taken steps after her complaints, including the co-worker’s departure.
The adjudication officer accepted Harty’s evidence, finding that the incidents occurred and that it was reasonable for her to resign. The WRC ordered compensation for the distress and effects of the discrimination and harassment. The decision states the award was not remuneration and was not subject to PAYE, PRSI or income tax.
