Breda O'Reilly entitled to redundancy pay based on service from 2002

The Workplace Relations Commission found Breda O'Reilly entitled, subject to her PRSI contribution status, to statutory redundancy pay based on continuous service from 23 October 2002 to 30 June 2020. The decision was dated 18 August 2022. O'Reilly, a playgroup leader, had received €9,693 based on service from 1 January 2010. She argued that her service should count from 1999, but the Commission excluded her earlier work on a community employment scheme because those workers were outside the classes covered by the Redundancy Payments Act. It found her service from October 2002 was continuous, including after the playgroup transferred to Castleview Community Playgroup CLG, and that the previous calculation was incorrect. The decision identifies a shortfall for service from October 2002 to December 2009 but states no amount for the additional entitlement.
