The Workplace Relations Commission found Colman Curran’s complaints of disability discrimination, unlawful wage deductions and constructive dismissal against Magna International Autolaunch Ireland Limited were not well founded. The decision was dated 21 February 2023. Curran said he was injured in a workplace altercation, did not receive full sick pay and had no option but to resign. The company said he received his full sick pay entitlement and resigned before its investigation and grievance procedures were completed. The WRC found there was insufficient evidence to establish discrimination. It found the sick pay and injury benefit schemes were applied according to their terms, and that Curran had not shown a fundamental contract breach or unreasonable employer conduct. It also found that he resigned before the investigation concluded and did not use the grievance procedure.
