The Workplace Relations Commission ordered E. Dunphy Ltd to pay Niall Reville €3,200 compensation after finding he was unfairly dismissed. The decision was dated 24 January 2023. Reville, a delivery driver, said he was dismissed after an altercation at the company’s yard on 8 July 2021. The employer disputed that he had been dismissed, saying he resigned. The adjudication officer found that the employer had not followed up or put a process in place after the incident. The officer found Reville had contributed 50% to the situation and said reinstatement or re-employment was unsuitable because the employment relationship had broken down.
