The Workplace Relations Commission ordered Clare County Council to pay Wayne Timmons €112.49 for a public holiday entitlement and €100 compensation after finding his complaint well founded. The decision was dated 24 January 2023.
Timmons, a temporary senior beach lifeguard, said he had not received the entitlement for the June 2021 public holiday. The council argued that he had not worked 40 hours in the five weeks beforehand. The adjudicator found that rule applied to part-time employees, while Timmons was full-time.
The WRC found his Sunday premium complaint not well founded, saying his hourly rate included compensation for Sunday work. It also found his fixed-term contract complaint not well founded because his successive contracts totalled 175 weeks, below the four-year threshold. His Payment of Wages complaint was withdrawn at the hearing.
