WRC awards Paul King €2,666 after finding unfair dismissal

The Workplace Relations Commission upheld Paul King’s constructive unfair dismissal complaint against Attitude Technology and awarded him €2,666 compensation. The decision was dated 6 December 2023. King said irregular pay dates, the withdrawal of his fuel card, an unsuitable replacement van and unpaid commission left him with no alternative but to resign. The company denied his claims in a written submission, saying commission was not due and the fuel card was cancelled because of cash-flow issues. It did not attend the hearing. The adjudication officer found the company’s conduct amounted to a serious breach of the employment contract and was so unreasonable that King could not fairly be expected to continue. Compensation was considered appropriate because reinstatement or re-engagement was not practical. The officer also noted that King provided no further evidence about his efforts to reduce his loss.
