WRC rejects disability discrimination complaint over post office mask dispute

The Workplace Relations Commission found that a post office respondent had not engaged in prohibited conduct and that Liam Condon’s disability discrimination and victimisation complaint was not well founded. The decision was dated 11 April 2023.

Condon said he was exempt from wearing a face mask and was asked to show an exemption letter during visits to the post office. He alleged that the respondent threatened to call gardaí, and that gardaí later visited his home. The respondent argued that he had not established a prima facie case and had not provided evidence of a disability.

The adjudication officer noted that Condon did not provide medical evidence to verify the exemption and that he was allowed to use the post office facilities. The officer found no facts from which discrimination or victimisation could be inferred. The complaint therefore failed.
