The Workplace Relations Commission found An Garda Síochána discriminated against Fergus Browne on nationality grounds and ordered €10,000 compensation. The decision was dated 15 February 2023. Browne held a four-month fixed-term clerical officer contract at Letterkenny Garda Station, which ended after 11 days.

Browne said he was dismissed because of his origin and had little training and inadequate work facilities. An Garda Síochána said the decision was based on performance and disputed protection under the claimed grounds. The officer found a report's reference to rumours and senior Gardaí's unwillingness to retain Browne was a key factor. Browne had complained to GSOC about alleged verbal abuse he believed was linked to his Northern Ireland origin; the officer found origin was a significant factor in his dismissal. The officer said the “Belfast Bomber” remarks were not directed at Browne and were not relevant to the decision.
