The Workplace Relations Commission found that Inchydoney Island Lodge and Spa Limited t/a Inchydoney Hotel did not discriminate against George-Calin Breban or victimise him after a dispute over mask wearing and a request for CCTV footage. The decision was dated 11 October 2022.
Breban said the hotel’s food truck refused to serve him coffee and ice creams because he would not wear a mask, although he said he was medically exempt. He also argued that the hotel’s refusal to provide CCTV footage was linked to his intended Equal Status complaint. The hotel said it followed mask guidance and would have refused footage to anyone who entered through a fire escape and filmed staff.
The adjudicator found Breban had not disclosed his disability to the food truck staff at the time, so he did not establish discrimination or a failure to provide reasonable accommodation. On victimisation, the adjudicator found the footage would have been withheld from a comparable person who behaved in the same way, regardless of an Equal Status complaint.
