The Workplace Relations Commission found Natalie Kilduff was not unfairly dismissed by Woodie's after she refused to work evening and weekend shifts. The decision was dated 15 February 2024. Kilduff said she had usually worked 9 to 5 and could not work evenings or weekends while caring for her terminally ill father. Woodie's said her contract required flexible hours and offered her the choice of transferring to Drogheda, remaining in Tallaght on flexible hours, or applying for an office-hours accounts role. The WRC found the offer of a similar store role with evening and weekend hours reasonable in light of the business’s needs and her contract. It also noted that the employer offered a 12-month transition to flexible hours. The officer criticised the decision to dismiss her by email without a face-to-face meeting, but concluded that the dismissal was not unfair.
