The Workplace Relations Commission found that Cambio Investments Ltd T/A Centra Stoneybatter did not discriminate against Stephen Kerr by requiring him to wear a mask during the Covid-19 pandemic. The decision was dated 25 January 2023.

Kerr said he had a medical exemption and was refused service or entry on two visits. The company said he refused to follow its mask policy and that it accommodated people unable to wear masks by shopping for them.

The adjudication officer accepted that Kerr could not wear a face covering for the stated medical reason. But the officer found it reasonable for the shop to require masks to reduce risks to staff and vulnerable customers in an enclosed, busy setting. The complaint under the Equal Status Act was found not well founded, and the WRC found there was no prohibited conduct.
