The Workplace Relations Commission found Joseph Varley’s Employment Equality complaint about the pay and conditions of Route 2 and Route 3 teachers not well founded. The decision was dated 25 January 2023. Varley argued that Route 2 teachers doing the same work as Route 3 teachers received less favourable pay and annual leave. The Department Of Education And Skills argued that his claim was outside the WRC’s jurisdiction because he had not based it on one of the statutory discrimination grounds. The adjudication officer found that Varley’s complaint did not fall within any of the nine grounds covered by the Employment Equality Acts and that she could not act outside the legislation. The WRC therefore found the complaint not well founded; the merits were not decided.
