The Workplace Relations Commission found Joan Thomas’s constructive dismissal complaint against Sallysalon Services (Ireland) Limited not well founded. The decision, dated 5 December 2022, said she resigned of her own volition and was not constructively dismissed. Thomas said workplace and payroll concerns had eroded her trust in the company, and she resigned in September 2021. The company denied constructive dismissal and said it followed its policies and kept in contact with her during sick leave. The adjudicator found Thomas had not fully discussed her difficulty returning to work because of childcare or made efforts to resolve it with the company. She had not exhausted available procedures or shown she had no option but to resign. The decision also found no significant breach of her employment contract.
