The Workplace Relations Commission found three complaints by former employee Emer Croston against Expert Safety not well founded in a decision dated 14 September 2023. Croston alleged the company unlawfully deducted training costs from her final pay and failed to meet its obligations over her employment terms and a claimed transfer of undertakings. The officer found the genuine contract allowed the training cost deduction when an employee left within a year, and Croston had received employer-funded training before leaving within her first year. The officer also found that Croston had received her contract before starting work and that two other contracts produced at the hearing were not genuine documents. Discussions about forming a limited company did not result in a transfer of undertakings. All three complaints failed.
