The Workplace Relations Commission found social care worker Caitriona Ryan’s Payment of Wages complaint not well founded and decided she was not discriminated against by Brothers Of Charity Services Ireland. The decision was dated 17 April 2023.
Ryan said her employer cut sleepover and premium pay after she was told to work from home during pregnancy, and that the reduction affected her income and maternity leave pay. The employer said her contract guaranteed 52 hours a fortnight but did not guarantee sleepovers or weekend shifts, and that high-risk staff working from home received basic pay. The WRC found the contract did not require the employer to offer sleepovers or weekend work, and that the same work-from-home arrangements applied to other high-risk employees. Both complaints failed.
