The Workplace Relations Commission found that Alan Cusack was not unfairly dismissed after taking pallets from Kyte Powertech Limited’s premises, and rejected his minimum-notice complaint. The decision was dated 3 April 2023. Cusack said he had permission from his line manager to take the pallets and argued that his dismissal and the disciplinary process were unfair. The company said he took them without permission and was dismissed for gross misconduct. The adjudicator found that Cusack knew of an express instruction not to remove the pallets and that the process did not deprive him of a fair hearing.
