The Workplace Relations Commission found Pavla Handlirova was unfairly dismissed by Robinson Cleaning Services (Irl) Ltd and ordered €17,250 compensation. The decision was dated 3 March 2023.
Handlirova had worked for the company since around August 2006. It said it dismissed her on capability grounds after a long illness absence and a further 12-week medical certificate. She argued she was not told dismissal was being considered or given a chance to respond.
The adjudication officer found she had not been notified that dismissal was under consideration or given an opportunity to be heard. The officer also found the company acted unreasonably in rejecting her appeal. Although her financial loss was assessed at €22,997.80, compensation was set at €17,250 as just and equitable. The officer was not satisfied that Handlirova met the standard for mitigating her loss.
