The Workplace Relations Commission found Luke Monaghan’s gender discrimination complaint against the National College of Art & Design not well founded. The decision was dated 8 August 2024.

Monaghan alleged the college failed to appoint an external investigator to examine his complaints, saying they would have been handled more thoroughly if he were a woman. The college said an external investigator had been appointed but withdrew, after which a staff member took over the investigation.

The officer found the college had not been notified within the required period that Monaghan intended to seek redress under the Equal Status Act, and declined to allow an exception to that notice requirement. The officer also found no basis to infer that the disputed treatment was because Monaghan was a man, noting that he had not identified a female comparator in similar circumstances who was treated more favourably.
