WRC awards Anthony Murphy €2,700 for unfair dismissal

The Workplace Relations Commission awarded Anthony Murphy €2,700 after finding his dismissal by Wexford PC Developments Limited was unfair. The decision was dated 23 August 2022. The award is equivalent to 13 weeks’ gross pay and is subject to statutory deductions. Murphy said he was selected unfairly for redundancy, dismissed over the phone and given no notice. The company said pandemic restrictions reduced available work and that it selected him because he did not drive. The officer found the job was not redundant and that the company failed to follow a standard dismissal procedure. No evidence showed Murphy contributed to his dismissal. His minimum notice complaint failed because he received a week’s pay in lieu of notice; his payment of wages complaint, considered under that notice complaint, also failed.
