Cork Builders Providers defeats mask discrimination complaint

The Workplace Relations Commission rejected Derek Blighe’s disability discrimination complaint against Cork Builders Providers over its refusal to let him enter a shop without a mask. Adjudication Officer Patsy Doyle dated the decision 23 August 2022.

Blighe said a medical condition prevented him from wearing a mask and that the company served him the hard hat he wanted outside the premises. He paid €8 for it. The company said masks were required and offered to bring the item to him.

The WRC found that Blighe had not established a disability within the meaning of the Equal Status Acts. His speech and language report did not confirm a diagnosis or describe a limitation. As disability was not established, the WRC also found no denial of reasonable accommodation, meaning adjustments to help a person with a disability use a service.
