The Workplace Relations Commission found Emma McGuinness was unfairly dismissed by T&C Environmental Services Ltd and ordered the company to pay her €11,544 in compensation. The decision was dated 27 June 2023.
McGuinness worked as an office accounts administrator from March 2019 until her dismissal in February 2021. The company said her role was made redundant because it needed to move the job to full-time hours as invoicing increased and delays built up.
McGuinness said she offered to work additional hours or share the job, and later proposed working 38 hours a week or three days in a sampling role. The adjudication officer found the company did not take enough time to consider those options, including her proposals, before dismissing her.
The officer awarded compensation equivalent to six months’ salary. The company had not displaced the presumption that the dismissal was unfair.
