The Workplace Relations Commission found that Boots did not engage in prohibited conduct after Sabrina McKeever complained that she was discriminated against when she was asked to wait outside while her prescription was filled. The decision was dated 19 October 2022.
McKeever said she was exempt from wearing a mask and that being sent outside humiliated her. She also said she would have been treated differently if she were a member of the Traveller community or had a different skin colour. Boots said it did not refuse service and gave her a prioritised prescription service, asking her to wait outside while it was prepared.
The adjudication officer found that McKeever had not established that she had a disability within the Act’s definition. The officer also found that Boots treated people who were not wearing masks alike and did not treat McKeever differently because of her alleged disability. The complaint was not well founded.
