The WRC found former Labour Inspector George McLoughlin’s protected-disclosure penalisation complaint against the Minister for Enterprise, Trade & Employment was not well founded in a decision dated 12 January 2022.
McLoughlin argued that the Minister penalised him by seeking costs in his High Court judicial-review proceedings. The Minister said the costs plea was part of its legal response and that any costs issue was for the High Court.
The adjudication officer found no penalisation had yet occurred because the judicial-review proceedings had not been heard and no High Court decision on costs had been made. The officer said the costs issue was for the High Court.
