WRC rules Ian Millar’s redundancy and commission complaints out of time

By Aoife Loughran

Historic decision · Decision date:

Place: no local area assigned from the source.

The WRC found it had no jurisdiction to hear Ian Millar’s complaints about redundancy consultation and unpaid commission because they were submitted outside the applicable time limits; the merits were not decided. The decision was dated 3 May 2022. Millar said Des Kelly Carpets Sallynoggin Limited failed to consult employees before making redundancies and withheld €150 commission for work done in October 2019. The officer did not find exceptional circumstances that justified extending the deadline for the redundancy complaint. The commission complaint was also outside the 12-month limit. The commission issue was investigated separately as an industrial relations dispute, and a recommendation was issued under the Industrial Relations Act 1969.
