WRC rejects Keith Gahan’s disability discrimination complaints against Nevilles Bakery

By Niamh Kearney

Historic decision · Decision date:

Place: no local area assigned from the source.

The WRC found Keith Gahan was not discriminated against by Nevilles Bakery and dismissed his two disability discrimination complaints. The decision was dated 21 February 2022.

Gahan said he was suspended after returning to work, was not given an adequate response to an interpersonal complaint and resigned after being told he would move departments. Nevilles Bakery disputed his account and said it had acted reasonably.

The adjudication officer found Gahan had not proved primary facts sufficient to raise a presumption of discrimination. The decision also treated a complaint mistakenly filed under section 86 as one under section 77 of the Employment Equality Act.
