The Workplace Relations Commission found that Vitalijs Nakaluznijs was not discriminated against by Dooley’s Pharmacy, was not denied reasonable accommodation and was not victimised after a dispute over wearing a face covering. He said he had a disability-related exemption. The pharmacy said it did not know of a disability or medical exemption, did not refuse service and offered alternative arrangements.
The adjudicator found Nakaluznijs had not disclosed a disability or provided evidence of a medical exemption. He was served and offered an alternative method of service. The victimisation claim failed because he provided no evidence of adverse treatment arising from a protected action. He withdrew his harassment claim at the hearing. The decision was dated 19 September 2022.
