The Workplace Relations Commission found that an agency worker was not told about a vacant position and awarded her €500. Its decision, dated 29 January 2024, concerned Aideen Nicholson’s complaint against National Parernts Council Post Primary.

Nicholson said general discussions about the organisation’s expansion did not tell her there was a position she could apply for. The respondent said there had been no vacancy as such and that staff had discussed the new role.

The WRC found the hirer had assumed Nicholson knew about the position but had not informed her of the vacancy as required by law. The decision means agency workers must be told about vacant jobs when the hirer informs its own employees, so they can apply.
