The WRC awarded Mihaela Cristina Branescu €880 compensation after finding she had been denied annual leave when she left Mervue Laboratories Limited. The decision was dated 4 January 2023. Branescu’s separate Payment of Wages complaint was not well founded. She had claimed unpaid wages, a €2,000 bonus and the cash value of return airline tickets. The adjudication officer found she had received the wages properly payable, the bonus was discretionary, and the tickets were a benefit in kind that could not be claimed as cash wages. The company had no records of annual leave taken. The officer found Branescu had been denied leave and directed the company to pay €880 compensation under the Organisation of Working Time Act 1997.
