The Workplace Relations Commission found that Forbairt Na Rossan Teoranta unfairly dismissed Enda McCarry by not renewing his fixed-term contract without investigating alleged poor performance or following fair procedures. Adjudication Officer Emile Daly’s decision was dated 7 January 2025.
McCarry said he had refused some instructions because of safety concerns affecting Community Employment scheme workers. The employer said he did not sign the 52-week contract it required for Department of Social Protection funding and cited performance concerns. The officer found McCarry’s conduct contributed 50% to the dismissal, including his failure to communicate safety concerns adequately and refusal of some instructions. The officer awarded €7,725, reflecting half of the compensation for 20 weeks’ proven loss.
