The Workplace Relations Commission found Olawale Olalade O Noah was not unfairly dismissed by Musgrave Operating Partners Limited Supervalu and that the Minimum Notice Act was not contravened. The decision was dated 28 March 2022. Noah said his representative had not communicated his account as he wished during the disciplinary process and that he received no notice when dismissed. The company said it dismissed him for gross misconduct following a disciplinary process. The adjudication officer found the process was fair, noting that Noah had union representation at each stage. He also found that the dismissal for gross misconduct after a fair procedure was permitted without notice.
