The Workplace Relations Commission awarded Louise Dunne €11,400 after finding she was unfairly dismissed by Apcoa Parking Ireland Ltd. In a decision dated 15 December 2022, it also awarded her €2,500 for breaches of rest-break rules.

Dunne worked three 12-hour overnight shifts and said she could not take breaks. The WRC found she could not take them and that Apcoa had not provided sufficient compensatory measures. It said the €2,500 was redress for the legal breach, not unpaid wages.

Dunne also said Apcoa’s handling of a colleague’s conduct led her to resign. Apcoa denied the complaints and argued she had not exhausted its grievance procedure. The WRC found that she had raised a grievance that Apcoa did not address, breaching trust and confidence and making it reasonable for her to end her employment.

Her separate wages complaint was not well founded because the money due had been paid. The WRC upheld her rest-break and unfair-dismissal complaints.
