The Workplace Relations Commission found that the Courts Service did not discriminate against John Holland on grounds of disability, fail to provide reasonable accommodation or victimise him. Adjudication Officer Valerie Murtagh’s decision was dated 7 June 2023.
Holland said he could not safely work in the office during the Covid-19 pandemic and that the Courts Service failed to accommodate him. The employer said it placed him on special leave with pay and sought to arrange a safe return to work.
The officer found that Holland had not provided evidence to substantiate disability discrimination. She said the Courts Service made bona fide efforts to engage with him and accommodate his medical condition, including proposing isolated work with individual tasks. Holland resigned before the disciplinary process reached a decision. His victimisation complaint also failed.
