The Workplace Relations Commission found that ATB Tyres Limited unfairly dismissed David Murphy and ordered it to pay him €750 compensation. The decision was dated 3 August 2022.
Murphy worked as a tyre fitter for the company from 1 March 2007 until 24 September 2020. He said bonus and annual leave issues, including the recovery of €450, led him to lose trust in his employer and resign. The company said the €450 was an advance and that he had resigned voluntarily.
The officer found the parties had different understandings of their July meeting and that the company had no written grievance procedure or clear explanation of the payment arrangements. Murphy had used the only available way to raise his concerns, and it was reasonable for him to resign.
His complaint under the Payment of Wages Act was not well founded because all wages properly payable had been paid before he complained. The officer found he had no financial loss after starting a new job and noted his unreasonable behaviour towards the owner when setting compensation.
