The decision was dated 7 January 2022. Hurst was barred from Bus Éireann school bus services after an incident in January 2020. His employer investigated and offered him alternative school bus driving work without a loss of income or change to his terms. He chose not to return, saying he was concerned about his removal from the Bus Éireann contract.
