The Workplace Relations Commission found Alistair McCabe’s constructive dismissal complaint against Prepay Power Limited not well founded in a decision dated 9 February 2022. McCabe said he resigned after problems including delayed mileage payments, lost commission, equipment and lead concerns, reduced hours and disciplinary investigations. The company argued that its conduct did not justify his resignation and that he had not used its grievance procedures. The adjudication officer found that managers had been accommodating and that McCabe should have raised his grievances through the company’s procedures before resigning. The officer also found that his contract allowed alternative duties during the pandemic and that he had received training for them.
