WRC finds Eileen Murphy’s constructive dismissal complaint against Cork school board not well-founded

The Workplace Relations Commission found Eileen Murphy’s constructive dismissal complaint against Presentation Secondary School Board of Management not well-founded. The decision was dated 25 October 2023. Murphy claimed the Board’s handling of a workplace grievance forced her out of her school secretary job after 41 years. The Board denied the claim, saying it followed the grievance procedure and that pandemic restrictions delayed mediation. The adjudication officer found Murphy had returned to work, chose to retire and had not exhausted the grievance procedure. The officer found she was not dismissed, constructively or otherwise, and ruled for the Board.
