The Workplace Relations Commission found Rachel Sweeney/ Ennis’s complaints of health and safety penalisation and constructive dismissal against the Health Service Executive not well founded. The decision was dated 22 January 2026.
The WRC accepted she had raised a safety concern and suffered a detriment, but found no causal link between the concern and the employer’s actions. It also found she had not made reasonable efforts to raise a grievance before resigning and was not constructively dismissed. Her separate working-time complaint was withdrawn.
