The Workplace Relations Commission found that Jowita Szymanska was not discriminated against on gender grounds in the allocation of Sunday working hours at Bidvest Noonan (ROI) Ltd. The decision was dated 4 January 2023. Szymanska said she received four hours on her Sunday shift while a male colleague on the alternate shift received six. She said she was offered extra hours at the lower ERO rate rather than her contractual rate of €22.40 an hour. The company said the colleague was paid the lower rate and that paying Szymanska for six hours at her higher rate was uneconomical. The WRC found the difference in hours was based on rates of pay, not gender, and that Szymanska was not required to complete six hours of work in four. It rejected the complaint.
