The Workplace Relations Commission awarded Lorraine Walsh €25,000 after finding her redundancy dismissal by The Blackdog Communications Ltd was unfair. The decision was dated 4 January 2023.
The company said the redundancy followed financial difficulties and fair procedures. Walsh argued her role was still being performed and she had been put on lay-off so she would resign and lose the value of her shareholding.
The adjudicator found there had been no change in the work: a director was paid consultancy fees to run the business after Walsh was removed. The dismissal was personal rather than an impersonal redundancy decision. Walsh had already received her redundancy lump sum, so the €25,000 compensation covered actual and prospective losses without a further award for lost redundancy rights.
