WRC rejects worker’s constructive dismissal complaint against health care provider

The Workplace Relations Commission found that a worker’s constructive discriminatory dismissal complaint against a health care provider was not well founded. The decision was dated 13 October 2023.

The worker said she was not properly supported when she returned to work while breastfeeding, including being directed initially to a disabled toilet to express milk, and that workplace treatment left her no choice but to resign. The employer said it arranged facilities and offered flexible hours. The WRC found it had made efforts to address her needs and that discrimination had not compelled her resignation.

The WRC also found the worker’s other equality complaints and her complaint under the Terms of Employment (Information) Act about misleading information on work location were out of time. Her complaint about an underpayment that had been rectified was withdrawn.
