The Workplace Relations Commission dismissed Martin Duffy’s unfair dismissal complaint against McHugh Express Limited, finding that his dismissal was fair. Adjudication officer Louise Boyle also found his complaints about wages and written employment terms were not well founded.
Duffy said he was unfairly dismissed and was owed wages and holiday pay, and that he had not received a contract or proper procedures. The company said it dismissed him after investigating alleged unauthorised van use and damage, vetting issues, late starts and missed disciplinary meetings.
Duffy attended the first hearing but missed the resumed hearing on 6 October 2023, despite being notified. Boyle considered the respondent’s evidence on the dismissal and found it fair. The decision was dated 8 May 2024.
