The Workplace Relations Commission awarded Pat Moloney €2,250 after finding that Eurostyle Ltd had underpaid him for annual leave and public holidays accrued during illness-related absence. Adjudication Officer Catherine Byrne dated the decision 31 January 2022.
Moloney had worked for Eurostyle since 1995 and became its IT manager. He was absent from work from August 2018 until his dismissal in March 2020. He said the company failed to accommodate his disability, unfairly dismissed him, withheld notice pay and underpaid his holiday pay.
The officer found that he was entitled to pay for 38.6 days of annual leave and 13 public holidays, but had been paid for only 41 days. The award comprised €1,450 in arrears of pay and €800 for breach of a statutory right.
The WRC found his disability discrimination, unfair dismissal and notice-pay complaints not well founded. Four other complaints were withdrawn at the hearing after his representative confirmed they were duplicates.
