The Workplace Relations Commission found two complaints by Matthew Jay against Peak Construction Ltd well-founded, ordering the company to pay €1,365 in notice pay and €400 for annual leave and a public holiday. The decision was dated 24 February 2023. Jay said he had worked for the company for four years and was put on temporary lay-off shortly before the pandemic. He said he did not return to work after the company told him there was no more work on 12 March 2020, and that he was owed two weeks’ notice and two days’ annual leave. The company wrote to the WRC about its circumstances and a planned receivership, but did not attend the hearing. The adjudication officer found Jay was entitled to two weeks’ notice pay, calculated at €682.50 per week. He also found Jay was entitled to three days of leave: two annual leave days and the public holiday on 17 March 2020, which fell within the notice period.
