WRC lacked jurisdiction over Moy Oil unfair-dismissal complaint

The Workplace Relations Commission found it had no jurisdiction to hear Mary McHale’s unfair-dismissal complaint against Moy Fuel Oil Limited t/a Moy Oil because she had less than one year’s continuous service. The merits were not decided. The WRC found there was no continuity of employment between McHale’s former employer, J&E Hughes Fuel Oil Limited, and Moy Fuel Oil. She had accepted a statutory redundancy payment after her position with the former company was made redundant in March 2019, then began working for Moy Fuel Oil later that April. The decision was dated 6 September 2022.
