The Workplace Relations Commission directed Linthrath Holdings Therapie Laser Clinics Ltd to pay €11,700 to a therapist after finding she was unfairly dismissed. The decision, dated 11 January 2023, said the company refused to honour an agreement for 22 days of annual leave a year, regardless of hours worked, and that this breach entitled her to resign. The company said it calculated part-time leave at 8% of hours worked, as it did for other part-time staff. The WRC found the discrimination complaint failed because the therapist had not shown less favourable treatment by comparison with another employee. Her statutory leave complaint was also not well founded: the adjudicator found she had received 98 hours, against claims for 34.56 hours of annual leave and 40 hours for bank holidays.
