The Workplace Relations Commission awarded Pavel Simik €2,750 after finding that his selection for redundancy was fundamentally unfair. The decision was dated 27 October 2022. Simik said he was selected without explanation and had been booked with clients every day. The respondent said the salon had reduced its stylists from three to two and selected Simik based on seniority. The adjudicator found there had been no consultation, advance notice that his position was at risk, discussion of selection criteria or consideration of alternatives to redundancy. Simik was unemployed from 4 March to 29 June 2020, and his loss was assessed at €4,128. The respondent did not attend the hearing to give evidence about the workforce reduction or selection process; a human resources consultant represented her.
