The Workplace Relations Commission found that Giri Kurichiyath was not discriminated against on grounds of race and was not unfairly dismissed after his permission to work in Ireland expired. The decision was dated 15 March 2023. Kurichiyath, who worked as a loss prevention officer, said the process used to address his right-to-work status was unfair and connected to his race and an application for promotion. TJX Ireland Unlimited Company said his permission to work expired on 19 October 2019 and that it could not lawfully continue employing him without valid permission. The adjudication officer found no evidence linking the process to Kurichiyath’s race or showing he was treated differently from other employees who needed work permission. The officer also found that TJX followed a fair procedure and dismissed him because he lacked valid permission to work after his existing permission expired. The WRC found both complaints not well founded.
