Noel Flood awarded €5,000 after WRC finds fixed-term contract breaches by Metropolitan Films

Noel Flood was awarded €5,000 after the Workplace Relations Commission found Metropolitan Films International Limited breached fixed-term work rules. In a decision dated 19 December 2023, the WRC found there were no objective grounds for employing Flood on successive specified-purpose contracts and that the company failed to explain those grounds in writing.

Flood worked as a rigger on film and television productions, including Vikings. The company argued he worked for separate production companies and that his complaint was out of time. The adjudication officer found the production companies were associated with Metropolitan Films and that Flood was laid off, rather than dismissed, while awaiting more work. The complaint was within the time limit.

The WRC found in Flood’s favour on the claims about successive contracts and the missing written explanation. His separate claim for a contract of indefinite duration was not well founded: although he had four years of continuous service, he had not shown four years of aggregate work under the contracts. The €5,000 compensation was for the fixed-term work breaches.
